Terms and Conditions of Use

1. About These Terms
1.1 These Terms and Conditions (“Terms”) govern your access to and use of the Home Visit Network website at homevisitnetwork.com.au and any related services, dashboards, and features (together, the “Platform”).
1.2 The Platform is operated by Ambidextrous Nexus Pty Ltd (ABN 84 634 910 991), trading as Home Visit Network (“Home Visit Network”, “we”, “us”, or “our”).
1.3 By accessing or using the Platform, whether as a business listing services or as a person searching for services, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1.4 Your use of the Platform is also governed by our Privacy Policy, which forms part of these Terms by reference and is available at [INSERT PRIVACY POLICY URL].
2. Definitions
In these Terms:
“BusinessMember” means an allied health, therapy, or related business that creates a listing on the Platform, whether on a free or paid subscription.
“User” means any person who accesses the Platform to search for, enquire about, or connect with a Business Member, including patients, family members, carers, case managers, and practice nurses acting on behalf of others.
“Listing” means the profile, description, service areas, and other content a Business Member publishes on the Platform.
“Services” means the therapy, healthcare, or related services delivered by a Business Member to a User. Services are delivered by the Business Member, not by Home Visit Network.
“Subscription” means a paid plan that a Business Member purchases to access additional Platform features.
“CPL” or “Cost Per Lead” means the optional per-lead bidding feature available to Business Members on paid plans.
3. The Nature of Our Service (Important)
3.1 Home Visit Network is an online directory and matching platform. Our role is limited to providing a place where Business Members can list their services and Users can search for and contact them.
3.2 We are not a healthcare provider. We do not provide, deliver, supervise, direct, or control any therapy, healthcare, or related Services. All Services are provided by independent Business Members who are solely responsible for them.
3.3 We do not employ, engage, or act as agent for any Business Member, and no Business Member is our employee, agent, or partner. Business Members are independent businesses.
3.4 We do not verify, vet, endorse, recommend, or guarantee any Business Member, their qualifications, their registration, their insurance, their character, or the quality, safety, or suitability of any Services. Any indication that a Business Member meets certain requirements reflects that Business Member’s own representations to us, not our independent verification.
3.5 We are not a party to any arrangement, booking, contract, or relationship formed between a User and a Business Member. Any such arrangement is solely between those parties.
3.6 Users are responsible for making their own enquiries and satisfying themselves as to the identity, qualifications, registration, insurance, suitability, and safety of any Business Member before engaging them, particularly given that Services may be delivered in a person’s home.
3.7 We do not guarantee that any User will find a suitable Business Member, or that any Business Member will receive any enquiries, leads, or business through the Platform.
4. Using the Platform — Users
4.1 You may use the Platform to search for and contact Business Members. The Platform is free for Users to search.
4.2 You must be at least 18 years old to use the Platform. If you are using the Platform on behalf of another person (for example as a family member, carer, or case manager), you confirm you are authorised to do so.
4.3 You agree to use the Platform lawfully and not to misuse it, including by submitting false enquiries, harvesting data, or contacting Business Members for purposes other than genuinely seeking Services.
4.4 Any information on the Platform is provided for general information only and is not medical, health, or professional advice. You should obtain appropriate professional advice for your specific circumstances.
5. Business Member Accounts and Listings
5.1 To create a Listing, you must register for an account and provide accurate, current, and complete information. You are responsible for keeping your account details and password secure and for all activity under your account.
5.2 You may create a Listing on a free plan or a paid Subscription. Your plan determines the number of Listings, service postcodes, and features available to you.
5.3 You are solely responsible for the content of your Listing and for keeping it accurate and up to date.
5.4 Business Member warranties
By creating a Listing, you represent and warrant on a continuing basis that:
you and all employees, contractors, and individuals delivering Services through your business hold all qualifications, registrations, licences, certifications, and permits required by law and by the relevant professional bodies to deliver those Services;
you maintain all insurance required by law and industry standards, including professional indemnity and public liability insurance appropriate to your Services;
you comply with all applicable laws, regulations, and professional and industry standards relevant to your Services, including those relating to in-home care and the safety of vulnerable people;
you hold any working-with-vulnerable-people, police, or similar checks required for the people and settings you serve;
all information in your Listing and provided to us is accurate and not misleading; and
you have the right to publish all content in your Listing and it does not infringe any third party’s rights.
5.5 Business Member obligations
You must deliver Services with due care and skill and in accordance with all professional and legal obligations that apply to you.
You must not engage in conduct that is unlawful, fraudulent, misleading, deceptive, harmful, or otherwise objectionable.
You must respond to User enquiries honestly and professionally.
You are responsible for your own arrangements with Users, including scheduling, fees charged to Users, service delivery, records, and complaints handling.
You must notify us promptly if any warranty in clause 5.4 ceases to be true.
6. Subscriptions, Billing and CPL
6.1 Paid Subscriptions are billed in advance through our payment provider, Stripe, on a monthly or annual cycle as selected at sign-up.
6.2 Subscriptions renew automatically at the end of each billing cycle at the then-current price, unless cancelled before the renewal date. By subscribing, you authorise us (through Stripe) to charge your payment method for each renewal until you cancel.
6.3 You may cancel your Subscription at any time through your dashboard or by contacting us. On cancellation, your access to paid features continues until the end of the current paid period, after which your account reverts to a free Listing or is closed. We do not provide pro-rata refunds for any unused portion of a paid period, except where required by the Australian Consumer Law (see clause 9).
6.4 We may change Subscription prices or features. We will give reasonable notice of any price change, and the new price will apply from your next renewal. If you do not accept a price change, you may cancel before it takes effect.
6.5 Cost Per Lead (CPL)
6.5.1 CPL is an optional feature available to Business Members on paid plans. It allows you to bid an amount per lead to influence your ranking or visibility, subject to a minimum of $5.00 per lead. A lead is defined as an email sent o your selected email address that includes the lead’s submitted contact details and information.
6.5.2 By enabling CPL, you authorise us to charge your payment method for leads generated in accordance with your settings. You are responsible for monitoring and managing your CPL settings.
6.5.3 We do not guarantee any particular number, quality, or outcome of leads. A lead means a User enquiry as defined in the CPL settings and does not guarantee that the User will engage your Services.
6.6 Fair use (Enterprise and higher plans)
6.6.1 Plans described as offering extensive coverage or multiple Listings are subject to fair use. We may contact you to discuss usage that is materially inconsistent with normal use of the plan.
7. Content and Intellectual Property
7.1 You retain ownership of the content you submit to your Listing. By submitting it, you grant Home Visit Network a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, adapt, and promote that content for the purpose of operating and marketing the Platform.
7.2 We may edit, reformat, moderate, suspend, or remove any Listing or content at our discretion, including where we consider it inaccurate, unlawful, misleading, or in breach of these Terms.
7.3 All Platform software, design, branding, text, and other materials we provide are owned by or licensed to us and may not be copied or used except as permitted by these Terms.
7.4 If you believe content on the Platform infringes your intellectual property rights, contact us at info@homevisitnetwork.com.au with details. We may remove allegedly infringing content and terminate the accounts of repeat infringers.
8. Suspension and Termination
8.1 You may stop using the Platform at any time. Business Members may cancel as set out in clause 6.
8.2 We may suspend or terminate your access to the Platform, remove your Listing, or close your account, with or without notice, if you breach these Terms, if any warranty you have given is or becomes untrue, if we are required to by law, or if we reasonably consider it necessary to protect Users, other Business Members, or the Platform.
8.3 If we terminate a paid Subscription for your breach, you are not entitled to a refund of fees already paid, except as required by the Australian Consumer Law.
8.4 Clauses that by their nature should survive termination (including clauses 3, 7, 9, 10, and 12) continue to apply after your use of the Platform ends.
9. Australian Consumer Law
9.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded, restricted, or modified (“Non-Excludable Rights”).
9.2 To the maximum extent permitted by law, where we are able to limit our liability for a breach of a Non-Excludable Right, our liability is limited (at our option) to resupplying the relevant service or paying the cost of having it resupplied.
9.3 The limitations in clause 10 apply subject to this clause 9.
10. Limitation of Liability
10.1 Subject to clause 9, and to the maximum extent permitted by law:
the Platform is provided “as is” and we do not warrant that it will be uninterrupted, error-free, or secure;
we are not liable for the acts, omissions, conduct, qualifications, insurance, Services, or safety of any Business Member, or for any loss, injury, damage, or harm arising out of or in connection with any Services, any home visit, or any dealing between a User and a Business Member;
we are not liable for any content, conduct, or communications of any Business Member, User, or other third party;
we are not liable for any indirect, incidental, special, consequential, or exemplary loss, or for loss of profits, goodwill, data, or business; and
our total aggregate liability to any Business Member in connection with the Platform is limited to the total Subscription and CPL fees paid by that Business Member to us in the 12 months before the event giving rise to the liability.
10.2 Because we are a directory and matching platform only (see clause 3), Users acknowledge that any claim relating to Services must be pursued against the relevant Business Member, not against Home Visit Network.
11. Indemnity
11.1 To the maximum extent permitted by law, each Business Member indemnifies Home Visit Network against any claim, loss, liability, cost, or expense (including reasonable legal costs) arising out of or in connection with: (a) the Business Member’s Services; (b) any breach of these Terms or of any warranty in clause 5.4 by the Business Member; or (c) any claim by a User or third party relating to the Business Member’s Services, Listing, or conduct. 12. General
12.1 Governing law. These Terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
12.2 Changes to these Terms. We may update these Terms from time to time. Changes take effect when posted on the Platform. Where a change is material, we will take reasonable steps to notify Business Members in advance. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
12.3 Severability. If any provision of these Terms is found to be invalid or unenforceable, it is to be read down or severed to the minimum extent necessary, and the remaining provisions continue in full force.
12.4 Waiver. A failure by us to enforce any provision is not a waiver of our right to do so later.
12.5 Assignment. You may not assign your rights under these Terms without our consent. We may assign ours in connection with a sale or restructure of our business.
12.6 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Platform.

1. Introduction
Ambidextrous Nexus Pty Ltd (ABN 84 634 910 991), trading as Home Visit Network (“we”, “us”, “our”), respects your privacy. This Privacy Policy explains how we collect, hold, use, and disclose personal information when you use our website at homevisitnetwork.com.au and related services (the “Platform”).
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Policy forms part of our Terms and Conditions.
2. What Information We Collect
We may collect the following kinds of personal information:
Identity and contact details — for example name, email address, phone number, and business details when you register, create a listing, or make an enquiry.
Business information — for business members, your listing content, service areas (postcodes), qualifications you choose to state, and subscription details.
Enquiry information — details you provide when contacting a business member through the Platform, which may include information about the person who needs services.
Payment information — for paid subscriptions, payment is processed by our payment provider, Stripe. We do not store your full card details; Stripe handles them under its own terms and security standards.
Technical and usage data — such as IP address, browser and device information, and how you use the Platform, collected through cookies and similar technologies.
3. Sensitive and Health Information
Enquiries may sometimes include health-related information about a User or the person they are enquiring on behalf of. We collect this only as needed to pass an enquiry to the relevant business member, and we treat it as sensitive information under the APPs. We do not ask Users to provide more health information than is necessary to make contact.
4. How We Collect Information
We collect personal information directly from you when you register, create or edit a listing, make an enquiry, subscribe, or contact us. We also collect technical information automatically through cookies and analytics tools when you use the Platform.
Where you provide information about another person (for example, a family member or client you are enquiring on behalf of), you confirm you are authorised to provide it and to have it handled as described in this Policy.
5. Why We Collect, Hold and Use Information
We collect, hold, and use personal information to:
operate the Platform and connect Users with business members;
create and manage accounts, listings, and subscriptions;
process payments and CPL charges through Stripe;
pass enquiries to the relevant business member;
respond to your questions and provide support;
send you service-related communications and, where permitted, marketing (which you can opt out of at any time);
improve, secure, and maintain the Platform; and
meet our legal obligations.
6. When We Disclose Information
We may disclose personal information to:
business members, when you submit an enquiry to them through the Platform (this is the core function of the Platform);
service providers who help us operate the Platform, such as our hosting provider, payment provider (Stripe), email and analytics providers, under obligations of confidentiality;
professional advisers, or where required or authorised by law; and
a purchaser or successor if we sell or restructure our business.
We do not sell your personal information.
7. Overseas Disclosure
Some of our service providers (for example, payment, hosting, or analytics providers) may store or process data outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with the APPs.
8. Cookies and Analytics
We use cookies and similar technologies to operate the Platform, remember your preferences, and understand how the Platform is used (including through analytics tools such as Google Analytics). You can control cookies through your browser settings, though some features may not work properly if you disable them.
9. Security
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If we become aware of a data breach that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act.
10. How We Hold and Retain Information
We hold personal information in electronic form through our systems and trusted service providers. We retain it for as long as needed to provide the Platform and meet our legal obligations, after which we take reasonable steps to delete or de-identify it.
11. Accessing and Correcting Your Information
You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, or misleading. To make a request, contact us using the details below. We will respond within a reasonable time and may need to verify your identity first. We may decline access in limited circumstances permitted by the APPs, and if so we will explain why.
12. Marketing and Opting Out
Where you have agreed or where permitted by law, we may send you marketing communications. You can opt out at any time using the unsubscribe link in our emails or by contacting us. We will still send you essential service-related communications.
13. Complaints
If you have a privacy concern or complaint, please contact us using the details below and we will investigate and respond. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The current version will always be available on the Platform, and the “Last updated” date shows when it last changed. We encourage you to review it periodically.
